Betrifft: Dritter Bericht des Vollmachtenprüfungsausschusses

Herr Präsident!

Der Gesamtausschuss hat auf seiner Tagung am 2. Oktober 1973 die Vollmachten von 16 Delegationen als gültig anerkannt und hat den Beschluss über die Vollmachten von zwei weiteren Delegationen auf heute vertagt. Der Vollmachtenprüfungsausschuss hat festgestellt, dass die belgische und die italienische Delegation inzwischen ebenfalls Vollmachten in guter und gehöriger Form vorgelegt haben. Sie empfiehlt daher der Konferenz, die Vollmachten dieser beiden Delegationen als gültig zu anerkennen, so dass 18 Delegationen in der Lage sind, das Uebereinkommen zu unterzeichnen.

Betrifft: Vorbereitende Arbeiten für die Eröffnung des Europäischen Patentamts

Zu dem von der Delegation der Bundesrepublik Deutschland vorgelegten Dokument (Dokument M/119/I) werden folgende Bemerkungen gemacht:

1. Von den Alternativen, die auf Seite 4 des Dokuments M/119/I dargelegt werden, ziehen wir aus folgenden Gründen einen kleineren zentralen Stab von etwa 6 Personen vor: In einem grösseren Stab müssen eine grössere Zahl von Ländern repräsentiert sein; dies würde wegen der dann wohl notwendigen Erörterungen und Erläuterungen Zeitverlust zur Folge haben. Ausserdem könnten auch nicht mit 20 Personen alle Anforderungen in bezug auf die Sachkenntnis abgedeckt werden. Im übrigen handelt es sich bei den hochqualifizierten Sachverständigen, die für diese Arbeit gebraucht würden, um Personen, deren ständige Entsendung nach München wir uns nicht leisten können. Die Arbeitsgruppen werden sich aus solchen hochqualifizierten Sachverständigen zusammensetzen, und sie sollten die Arbeit grundsätzlich nach dem Prinzip der Arbeitsteilung ausführen. Sie können dies daheim ohne grössere Beeinträchtigung ihrer normalen beruflichen Tätigkeit und ihres Familienlebens tun.
2. Solange es kein stärkeres Argument für einen kleinen, ständigen, zentralen Stab in München gibt, sollte dieser nur eingesetzt werden, wenn sehr gute Aussichten für eine kontinuierliche Beschäftigung bestehen. Wir möchten nämlich nicht gezwungen sein, einmal nach München entsandtes Personal in die Heimatländer zurückzubeordern.
3. Wird ein zentraler Stab eingesetzt, so sollte er als fachliche Komponente des Sekretariats arbeiten, d.h. die Tätigkeit der Arbeitsgruppen koordinieren und die ihm von den Arbeitsgruppen zugewiesenen Planungsaufgaben durchführen. Aus dem unter

Nummer 2 dargelegten Grund wäre München als Standort für den Stab besser geeignet als Brüssel, jedoch müsste der Stab eine enge Verbindung zum Sekretariat in Brüssel aufrechterhalten.

4. Falls hinsichtlich der Kontinuität der Beschäftigung ernsthafte Zweifel bestehen (vgl. Nummer 2), so wäre es besser, überhaupt keinen ständigen Stab vorzusehen. Statt dessen könnten namentlich bezeichnete Personen hauptamtlich am Heimatort tätig sein, aber einen grossen Teil ihrer Zeit in Brüssel verbringen.

5. Brüssel wäre ein leichter zu erreichender Tagungsort für die Delegationen; ausserdem befindet sich das Sekretariat mit all seinen Einrichtungen in Brüssel. Dies sollte bei der Beschluss darüber, ob die Tagungen in München oder Brüssel stattfinden sollen, voll berücksichtigt werden. Ausser in den Fällen, in denen besondere Gründe die Wahl Münchens als Tagungsort rechtfertigen, sollte unseres Erachtens aus den vorstehenden Gründen Brüssel der Vorzug gegeben werden.

6. Für den Fall, dass ein zentraler Stab in Brüssel eingesetzt wird, sollten die Kosten für die Räumlichkeiten, das erforderliche Personal und die Ausrüstung dem ersten Haushaltsplan der Europäischen Patentorganisation angelastet werden. Wir gehen davon aus, dass die Grundgehälter des dem Stab zugewiesenen Personals weiterhin von den einzelnen Ländern gezahlt werden. Aber selbst dann müssten alle zusätzlichen Kosten (Reisekosten, Auslandsauflage und Kosten für den Umzug der Familien) ebenfalls von der Europäischen Patentorganisation getragen werden.

7. Das IIB sollte Beobachterstatus erhalten und in vollem Umfang an der Arbeit beteiligt werden. INCOPOSA sollte ebenfalls Beobachterstatus erhalten und auf Einladung des Interimsausschusses oder der Arbeitsgruppen zu allen Arbeiten, an denen diese Organisation interessiert ist, zugelassen werden.

Herr Präsident!

Es ist Ihnen bekannt, dass der Vollmachtenprüfungsausschuss am 25. September 1973 einen ersten Bericht vorgelegt hat und dass der Gesamtausschuss aufgrund dieses Berichts alle Regierungsdelegationen zur Konferenz zugelassen hat. Alle diese Delegationen können daher die Schlussakte unterzeichnen.

Der zweite Bericht, den ich Ihnen vorzulegen heute die Ehre habe, betrifft daher lediglich die Vollmachten, die die einzelnen Delegationen zur Unterzeichnung des Uebereinkommens berechtigen.

Der Vollmachtenprüfungsausschuss hat festgestellt, dass 16 Delegationen Unterzeichnungsvollmachten in guter und gehöriger Form vorgelegt haben. 2 Delegationen (Belgien, Italien) haben mitgeteilt, dass sie spätestens bei der Unterzeichnung Vollmachten vorlegen. 3 Delegationen (Finnland, Oesterreich, Türkei) haben schliesslich dem Sekretariat mitgeteilt, dass sie nicht die Absicht haben, Vollmachten vorzulegen, die bereits jetzt zur Unterzeichnung des Uebereinkommens berechtigen; davon bleibt jedoch die Möglichkeit unberührt, die Unterzeichnung innerhalb der in Artikel 165 des Uebereinkommens festgelegten Frist vorzunehmen.

Der Vollmachtenprüfungsausschuss empfiehlt daher dem Gesamtausschuss, die Vollmachten der folgenden 16 Delegationen als gültig anzuerkennen:

- Luxemburg

- Niederlande

Ferner empfiehlt der Vollmachtenprüfungsausschuss dem Gesamtausschuss, einen Beschluss über die Vollmachten der übrigen Delegationen erst bei der Unterzeichnung des Uebereinkommens zu fassen.

Zu diesem Zeitpunkt werde ich, wenn Sie es mir gestatten, im Namen des Vollmachtenprüfungsausschusses einen ergänzenden Bericht vorlegen.

Die Konferenz über die Einführung eines europäischen Patenterteilungsverfahrens, die am 5. Oktober 1973 in München zusammengetreten ist, -

in Erwägung, dass

- die künftige technologische Entwicklung sich nicht auf den nationalen oder regionalen Rahmen beschränken darf,
- die Industrieländer aufgrund ihrer wirtschaftlichen Struktur am besten dazu in der Lage sind, den technologischen Fortschritt zu fördern,
- nicht alle Länder der Welt in der Lage sind, den technologischen Fortschritt in gleichem Masse zu fördern,
- die Bemühungen der Entwicklungsländer um eine Verringerung des technologischen Abstands gegenüber den hochentwickelten Ländern zu unterstützen sind,
- sichergestellt werden muss, dass die Ergebnisse des technologischen Fortschritts allen Ländern zugute kommen -

ERSUCHT DIE EUROPAEISCHE PATENTORGANISATION,

unter Beachtung der von anderen zwischenstaatlichen Organisationen getroffenen Massnahmen alle zur Verfügung stehenden Möglichkeiten zu nutzen, um den Entwicklungsländern unabhängig von ihrer geographischen Lage zu helfen, und zwar insbesondere in bezug auf die Dokumentation, die Ausbildung von Personal und alle sonstigen Mittel, welche diese Länder immer näher an den Stand der hochentwickelten Länder heranbringen können.

betreffend vorbereitende Arbeiten für die Eröffnung des
Europäischen Patentamts (Dok. M/119/I)

Die Delegation des IIB hat die Vorschläge der deutschen Delegation zur Organisation und zum Arbeitsprogramm des Interimsausschusses mit grossem Interesse zur Kenntnis genommen. Sie hält diese Vorschläge für eine ausgezeichnete Diskussionsgrundlage. Zur Frage der Beteiligung des IIB an den Arbeiten des Interimsausschusses, weist die Delegation auf folgende Punkte hin.

1. Es trifft gewiss zu, dass der deutschen und der niederländischen Regierung eine besondere Verantwortung für die Errichtung des europäischen Patentsystems zukommt. Dieselbe Feststellung trifft jedoch auch für das IIB zu. Diese Organisation wird nämlich denjenigen Bestandteil des EPA bilden, der als erster voll funktionsfähig sein muss. Im Hinblick darauf wird das IIB, obwohl es zunächst noch einen Status haben wird aufgrund dessen es ausschliesslich der Kontrolle durch seine Mitgliedstaaten unterliegt, von nahezu allen Massnahmen des Interimsausschusses unmittelbar betroffen sein, insbesondere auf dem Gebiet der Organisation, der Recherche, des Personals, der Finanzen und des Vertragsrechts (Arbeitsgruppen 1, 2, 3 und 5 der in Dok. M/119/I vorgesehenen Gruppen). Das IIB wird deshalb einen erheblichen aktiven Beitrag zur Konzeption und Durchführung der Arbeiten des Interimsausschusses zu leisten haben. Gegebenenfalls wird das IIB wichtige interne Massnahmen, z.B. im Bereich der Organisation, der Ausbildung des Personals und der Einstellung neuen Personals bereits vor dem Zeitpunkt seiner Eingliederung in das EPA zu ergreifen haben.

Aus den vorstehenden Gründen ist die Delegation des IIB der Auffassung, dass es unerlässlich ist, dass der "Beschluss betreffend vorbereitende Arbeiten für die Eröffnung des Europäischen Patentamts" (Dok. M/8) in einer Weise angewandt wird, die eine angemessene Beteiligung des IIB an allen Arbeiten des Interimsausschusses und seiner Organe sicherstellt, die einschliesst, dass das IIB befugt ist Vorschläge vorzulegen und bestimmte Funktionen im Rahmen der Organe des Interimsausschusses zu übernehmen. Die Delegation des IIB ist der Meinung, dass diese Punkte ausdrücklich in der Verfahrensordnung des Interimsausschusses berücksichtigt werden sollten.

2. Die Delegation des IIB hält den Vorschlag der Bildung eines Aufbaustabs, dessen Aufgabe in der Ausarbeitung der Arbeitsunterlagen für den Interimsausschuss besteht, für sehr erwägenswert. Sie möchte in diesem Zusammenhang darauf hinweisen, dass die Arbeiten, die im Rahmen des Interimsausschusses durchzuführen sein werden, sich ihrer Natur nach weitgehend von denjenigen unterscheiden werden, die in der Vergangenheit im Rahmen der Regierungskonferenz geleistet worden sind.

Die Aufgabe des Interimsausschusses wird sich nämlich nicht auf die Erstellung von Vorschriften und anderen Texten beschränken, sondern sich schrittweise auf die faktische Errichtung des europäischen Patentsystems erstrecken. Diese Feststellung trifft besonders auf das Gebiet der Recherche zu, auf dem die Tätigkeit der verschiedenen an europäischen Recherchen beteiligten Stellen koordiniert und ihrer neuen Aufgabe angepasst werden muss.

Unter der Voraussetzung, dass eine angemessene Vertretung der interessierten Staaten und des IIB in dem von der deutschen Delegation vorgeschlagenen Aufbaustab sichergestellt werden kann, dürfte die Schaffung eines solchen Stabes die Errichtung des Europäischen Patentamts und die Eingliederung des IIB in dieses Amt erleichtern.

Die Konferenz über die Einführung eines europäischen Patenterteilungsverfahrens, die am 5. Oktober 1972 in München zusammengetreten ist -

IN DEM WUNSCH, alles Erforderliche zu tun, damit das Europäische Patentamt im Interesse der technischen und wirtschaftlichen Entwicklung Europas seine Tätigkeit so bald wie möglich aufnehmen kann -

FASST folgende Entschliessung:

1. Aus Anlass der Unterzeichnung des Uebereinkommens über die Erteilung europäischer Patente möchte die Diplomatische Konferenz über die Einführung eines europäischen Patenterteilungsverfahrens dem Rat der Europäischen Gemeinschaften ihren Dank dafür aussprechen, dass er ihr - wie schon ihrem Vorgänger, der Regierungskonferenz über die Einführung eines europäischen Patenterteilungsverfahrens, sein Sekretariat einschliesslich seines juristischen Dienstes zur Verfügung gestellt hat. Der gleiche Dank richtet sich auch an den Generalsekretär der EFTA. Die Diplomatische Konferenz ist der Ueberzeugung, dass diese in der Erarbeitung internationaler Vertragswerke erfahrenen Dienststellen wesentlich zum Erfolg ihrer Arbeiten beigetragen haben.

2. IN DEM WUNSCH, dass das nunmehr von ... Staaten unterzeichnete neue europäische Vertragswerk so bald wie möglich ausgeführt und zu diesem Zweck das Europäische Patentamt eröffnet werden kann, richtet die Diplomatische Konferenz an den Rat der Europäischen Gemeinschaften sowie an den Generalsekretär der EFTA die Bitte, die genannten Dienststellen auch für die Interimsarbeiten der sich auflösenden Diplomatischen Konferenz, die mit der für das Jahr 1976 in Aussicht genommenen Eröffnung des Europäischen Patentamts enden werden, zur Verfügung zu stellen.

On Monday 10 September the Plenary of the Munich Diplomatic Conference set up a Committee of the Whole and three Main Committees to examine the texts of the Convention which had been drawn up and, in addition, a Credentials Committee and a Steering Committee responsible for the progress of the Conference.

Main Committee I began its work on Tuesday 11 September and met up to and including Saturday 25 September, i.e. for almost three weeks, with Dr Haertel, President of the German Patent Office, in the Chair. The Committee concerned itself with the provisions relating to patent law proper of the design of the European Patent Convention and its Implementing Regulations, with the Protocol on the Definition of Decisions in respect of the Right to the Right of a European Patent, with a Recommendation on preparations for the opening of the European Patent Office as well as with a Recommendation on the training of its staff.

Main Committee II met from Tuesday 11 September until Saturday 22 September, i.e. for almost two weeks, under the Chairmanship of Mr Savage, the President of the French Patent Office. During this time the Committee examined the general and institutional provisions of the Convention, the Protocol on the Centralisation of the European System and on its Introduction and the Protocol on Privileges and Immunities of the European Patent Organisation.

Main Committee III discussed the financial provisions of the Convention on Monday 24 and Tuesday 25 September, i.e. for two days, under the Chairmanship of Mr Armitage, the President of the British Patent Office.

The Steering Committee, which consisted of the Chairmen of the three Main Committees, the Secretary-General of the Conference and its General Rapporteur, met for one hour on four occasions under the Chairmanship of Dr Haertel to discuss the organisation and the progress of the Conference; this task was not however difficult, firstly because of the excellent preparation of the Conference by the Government of the host country and secondly because of the efficient Chairmanship of the three Main Committees.

Finally, the Credentials Committee met three times in order to examine the full powers of the Government Delegations and the letters of appointment of the Observer Delegations. The results of the work of the three Main Committees and the Credentials Committee were forwarded to the Committee of the Whole, which met from Monday 1 October until the morning of 4 October, i.e. for four days, with Dr Haertel in the Chair. The Committee of the Whole concerned itself primarily with examining the results of the work of the three Main Committees which were forwarded to it after the Drafting Committees of the three Main Committees had examined the texts as to drafting and after the General Drafting Committee had carried out the final drafting.

The result of this examination was that a unanimous decision was taken to forward a complete text amended on points of detail, of the European Patent Convention, its Implementing Regulations and the Protocols to the Plenary.

The Committee of the Whole also concerned itself with:

1. a report of the Credentials Committee,
2. a discussion on the organisation of the planned European School in Munich and on the building planned for the European Patent Office in Munich, and
3. a discussion of the programme and the organisation of the Interim Committee to be set up for the preparation of the opening of the European Patent Office.

You now have before you the texts, unanimously approved by the Committee of the Whole, of a European Patent Convention comprising 178 Articles, of the Implementing Regulations comprising 106 Rules, and of the relevant Protocols.

The several weeks of work, especially on the part of Main Committees I and II, might lead one to think that the text of the Convention and its connected documents, as submitted by the Luxembourg Inter-Governmental Conference to our Diplomatic Conference, have been amended to a considerable degree. Nothing, however, is further from the truth. The drafts prepared by the Luxembourg Inter-Governmental Conference were the result of intensive work under the excellent supervision and guidance of Dr Haertel, extending over more than a decade, which involved not only Government delegations but also representatives of the interested circles in Europe. This intensive work is reflected in a well thought out draft of a modern body of European patent law for the grant of European patents. This draft was so well prepared that its essential parts were retained unchanged by the Diplomatic Conference.

The hard work at this Diplomatic Conference was thus mainly confined to resolving outstanding problems of detail. I shall confine myself in a brief survey to the most important amendments and would refer the reader interested in the details to the excellent reports drawn up by the rapporteurs of the three Main Committees, Mr Brändli, Mr Bowen and Mr Fressonnet. I would first of all like to make some general observations:

Anybody today applying for a patent for an invention which he has made is required to file a separate application for that invention in each country in which he has an economic interest. In view of the varying number of patent applications and the present state of international co-operation in Europe, especially in this field, this is becoming an ever more difficult problem. Thus the Convention before you provides for European procedures for the

grant of European patents by a European Patent Office on the basis of European patent applications filed with it. The European patent granted as a result will produce its effects in all the Contracting States designated by the applicant. The patent will continue to be subject to national law and will thus have the effect of a bundle of national patents but these national patents will at least have a uniform, examined content vis-à-vis all the designated States. The patent grant procedure consists of three stages.

Firstly, upon filing, the application is examined as to formal requirements, searched as to novelty and then published, together with the results of this search in the form of a European search report, for the purposes of public information. Subsequently, in the second stage of the procedure, and at the request of the applicant, the actual procedure for grant is carried out; this involves examination of the application as to the substantive requirements for patentability laid down in the Convention, entailing an examination as to novelty and in particular an examination of the actual inventive step which the application represents. This procedure will then either give rise to the grant of a patent with the application usually having been amended, or, in a certain number of cases, to the application being refused. In the third stage of the procedure, third parties may, within a period of nine months of the grant of the patent, file an opposition against it which, after examination by the European Patent Office, will result in the patent being either revoked or maintained.

At each stage of the procedure there is a right of appeal against decisions of the departments of the first instance to an appeal instance of the European Patent Office.

Having described the basis of the Convention, I shall now deal briefly and in greater detail with the amendments made by the Diplomatic Conference. I have arranged my comments according to the four main parts of the European Patent Convention, i.e.:

1. the European Patent Office;
2. substantive patent law;
3. procedure up to grant;
4. requirements of the European patent application.

(a) First the European Patent Office. According to the draft submitted to the Diplomatic Conference, the European Patent Office will have its seat at Munich but it will also have a branch at The Hague. The Office at Munich will be responsible for all the examination under the second and third stages of the procedure, while it will be incumbent upon the branch at The Hague to carry out the first stage of the procedure. According to the draft, the branch would deal only with the examination as to formal requirements of European patent applications and their publication, but would work in liaison with the International Patent Institute at The Hague, which has already for many years been searching patent applications as to novelty, on behalf of its member countries and to which searches in respect of European patent applications would be transferred. At the same time however, the Protocol on Centralisation of the Convention provides for the International Patent Institute to be incorporated into the European Patent Office, which would mean that a self-contained unit of the European Patent Office would be created at The Hague which would be responsible for the whole of the first stage of the European procedure mentioned above. This concept has been incorporated in the final text of the Convention in the sense that reference is now no longer made to the transfer of search tasks to the International Institute at The Hague, but to the fact that the incorporation of the International Patent Institute into the European Patent Office will take place before the opening of this Office, with the consequence that searches in respect of European patent applications will also be carried out by the European Patent Office itself, that is to say by the branch at The Hague.

(b) The European system for the grant of patents is based on the centralisation both of search as to novelty and of examination at the European Patent Office. One certainty is that the introduction of the European procedure will mean a reduction in the activity of national patent offices, because a steadily increasing number of applicants will go over from the national to the European procedure. In order to facilitate the adaptation of these national offices to the new situation, provision has been made in the Protocol on Centralisation for a transitional period of 15 years, during which time it will be possible, in respect of a maximum of 40% of

European patent applications for a part of the examination, i.e. the second stage of the procedure with the exception of the decision to grant a patent, to be transferred to the national offices of the Contracting States on a decision of the Administrative Council. The position of the British Patent Office in particular is borne in mind here. This possibility previously existed only with respect to examination. Now however, in the course of this Diplomatic Conference, this possibility has been extended to searches in respect of European patent applications for countries which dispose of adequate searching facilities but basically only those in which the official language is one of the three official languages of the European Patent Office. This in particular takes Austria into account.

It is intended that during the transitional period the transfer of duties in accordance with these provisions should be gradually phased out. It will always be open to the European Patent Office, once the transitional period is at an end, to conclude working agreements with national offices for transferring tasks in the framework of the European procedure, but the only decisive factor here will be the interests of the Office itself, for example if it is no longer able to cope with its work in a satisfactory manner for lack of staff.

(c) The search as to novelty in respect of European patent applications will be carried out at the European Patent Office using technical documentation available in German, English and French, but in principle, for the time being at any rate, not documentation in other languages of the participating countries. In anticipation of a planned extension of material to appropriate documentation in the languages of other Contracting States it is now provided that the sub-office to be set up in Rome and national offices of Contracting States which have a language other than one of the official languages of the European Patent Office, particularly the Scandinavian countries, will be able to carry out additional searches, using documentation at their disposal in their own languages, in respect of European patent applications submitted by their nationals or in respect of other European patent applications, should the applicant so request.

(d) The financial provisions of the Convention are based upon the assumption that the European Patent Office will pay for itself in the long term, i.e. that its expenditure will be covered partly by the fees levied by the European Patent Office itself, and partly by a portion of the renewal fees for European patents which will be required of patentees by each State for which the patent is valid, in accordance with its national provisions. However, during a transitional period which will allow the European patent system to get under way, the Contracting States will have to pay financial contributions according to a scale laid down in the Convention; this scale was discussed in detail at the Conference but was not amended. The financial provisions make it likely that the European Patent Office will be able to balance its budget through its own resources in the tenth year of operation, and it is planned that the amounts of the fees will be such as to allow the Contracting States' special financial contributions to be gradually repaid with interest.

(e) The provisions of the Convention and of the Implementing Regulations which deal with professional representation before the European Patent Office lay down comprehensive arrangements for European professional representatives, with a European qualifying examination and some form of disciplinary power the details of which remain to be worked out and which will apply only after the end of a transitional period. The principles of the arrangements for professional representation were discussed in detail with the interested circles but were not amended during the Conference. However, a few changes were made to the representation arrangements which are to apply during a transitional period; these were based on the provisions of national law in view of the present differences therein and the intention of preserving acquired rights.

Basically, professional representatives who are entitled to act as such before the national patent office of any of the Contracting States during this transitional period will be entitled to do the same before the European Patent Office, subject to certain conditions. It was initially envisaged, however, that any restrictions on representation under the national law concerned should also apply in proceedings before the European Patent Office.

The Conference considered that these restrictions were justified in national proceedings only and could therefore be discarded in respect of the European proceedings. It also considered that the provision whereby, during the transitional period, entitlement to act as a professional representative before the European Patent Office was dependent upon entitlement to so act before a national patent office, was justified during the transitional period only; for this reason it was laid down that all representatives entitled to act in the European proceedings during the transitional period would continue, after the expiry of this period, to be entitled to act as European professional representatives before the European Patent Office irrespective of their national entitlement. The Conference also laid down that professional representatives would be allowed to establish a place of business, for the purpose of exercising their profession before the European Patent Office, not only in Munich and the Netherlands, but also wherever any part of the European proceedings would take place before a national authority on behalf of the European Patent Office.

Moving on to the provisions of the Convention dealing with substantive patent law, the only amendment made by the Conference in this respect was to lay down that if the subject-matter of a European patent is a process, the protection conferred by the patent is to extend to the products directly obtained by such process. As a result, the Convention here becomes involved with the rights conferred by a patent and so makes an inroad into national law, but such was already the case in respect of the conditions for patentability and the range of patentable inventions, which form the basis not only for the grant of European patents, but also for the validity of the granted patent in national proceedings. In order to make accession to the Convention easier for those States whose level of economic development would not allow them to adapt to the above-mentioned provisions, the possibility was provided of making reservations in respect of a transitional period. The Diplomatic Conference reconsidered the reservation option and extended it in three respects. First of all, the right to provide that European patents for pharmaceutical and food products as such are to be ineffective

or revocable was extended to chemical products as such, but at the same time it was specifically stated that this reservation does not affect protection conferred by a patent in so far as it involves a process of manufacture or use of a chemical product. Secondly the Administrative Council of the European Patent Organisation was empowered to extend the transitional period for reservations (10 years after the entry into force of the Convention) by not more than 5 years at the request of the State concerned. Thirdly, it was laid down that reservations would remain effective, even after the expiry of the transitional period, in respect of patents granted on European patent applications filed during that period, with the result that reservations will be phased out only gradually. It is to be hoped that the Conference will not have troubled itself in vain with these additions in its attempts to make it easier for certain European States to become parties to the Convention.

With regard to the European system for the grant of patents itself, while many changes in non-essential details were introduced, only two changes are worthy of mention in this general report. The first concerns a deletion by which a source of complication was removed, namely, the fee for any supplementary searches as to novelty necessary in the procedure. The second change concerns an applicant for or proprietor of a patent who has been prevented from observing a time limit vis-à-vis the European Patent Office. He can now request restitutio in integrum not only in cases of force majeure but in all cases where in spite of the exercise of all due care, he is prevented from observing a time limit.

Finally, the Diplomatic Conference also introduced some changes of detail in the requirements of European patent applications. It has now provided unequivocally that the European patent application may be filed either at the European Patent Office at Munich or at its sub-office at The Hague. The increased recognition of the inventor's legal position is also important. This has been achieved by not only requiring the applicant to mention the inventor

in addition, by requiring any applicant who is not the inventor, or not the sole inventor to supply a statement on the legal laws of the acquisition of the invention. The obligatory forwarding of this statement to the inventor is designed to protect any rights possessed by the latter. Moreover, the Conference dealt thoroughly with the problem of European patent applications concerning micro-organisms, the source in particular of many pharmaceuticals. The result is a detailed provision, which is as well-balanced as possible, and which, while protecting the rights of the public by providing for the compulsory deposit of the micro-organism in a culture collection where it is available to the public at the time the application is published, also, secures the rights of the applicant for or proprietor of the patent by rules to prevent illicit use of the micro-organisms thus made available.

Thus, a Convention on the Grant of European Patents has been prepared which is the result of years of co-operation by persons from many European countries. The continuation of this work at the Diplomatic Conference has removed the last remaining defects. For the completion of this work we are indebted to many people. Firstly, thanks are due to the experts of the Government Delegations and to the interested circles, who, though aware that it entailed a sacrifice of national sovereignty and of their sphere of work, created the Convention in an enthusiastic spirit of European collaboration. However, to one man in particular belongs the merit of having inspired them in this undertaking, namely, to Dr Haertel, a convinced and ardent European, who right from the start guided the negotiations in a manner admired by all. Finally, the Convention would certainly not have been completed were it not for the hard work of the silent helpers in the background, the staff of the Secretariat of the EEC Council of Ministers in Brussels.

It is therefore right that we should now adopt the Convention, a system of European patent law, which will determine the fate of patents in Europe for many years to come and I would now recommend you to do so.

The IIB delegation has taken note with great interest of the proposals made by the German delegation in respect of the organisation and working schedule of the Interim Committee. The IIB delegation is of the opinion that these proposals constitute an excellent basis for discussion. In regard to its own participation in the work of the Interim Committee, the IIB considers it necessary to recall to mind the following items:

1. If it is agreed that, in the setting up of the European System, a special responsibility lies with the Netherlands and German Governments, then the same is true for the IIB. This organisation constitutes indeed the first stage of the EPO which must be fully operational. In this respect the IIB, while provisionally retaining its status according to which it is only subject to the control of its Member States, will be directly concerned by the majority of the measures adopted by the Interim Committee, in particular in the fields of organisation of the search, personnel, finance and the right to conclude contracts (Working groups 1, 2, 3 and 5 of the groups provided for in doc. M/119/I). For this reason the IIB will have a duty to make an active contribution in the planning and execution of the work of the Interim Committee and of its dependent organs. It is also possible, that considerable internal reorganisation will have to take place within the IIB even before its incorporation in the European organisation, for example in the fields of administrative structure, of staff training and of recruitment.

In the light of the foregoing, the IIB delegation considers it to be indispensable that the "decision on preparations for the opening of the European Patent Office" (M 8) should be applied in such a way that adequate participation of the IIB is guaranteed, as much in the work of the Interim Committee as in that of its dependent organs. This participation should, in particular, include the right for the IIB to put proposals, and to take up duties within the dependent organs of the Interim Committee. The IIB delegation considers that particular mention of these points should be made in the internal regulations of the Interim Committee.

2. The IIB delegation finds of considerable interest the proposal to set up a permanent team consisting of approximately twenty officials, who would have the duty to prepare working documents which would act as a basis for discussion in the Interim Committee and its dependent organs. In this respect it is appropriate to underline the fact that the work which the Interim Committee will have to carry out will, in many regards, be of a different nature to that previously accomplished within the framework of the Intergovernmental Conference.

The task of the Interim Committee is not, indeed, limited to the drafting of texts, but will progressively extend so as to include the implementation of the European Patent System. This is particularly true in the field of searching, where the activity of the various organs concerned must be adapted and coordinated in the light of their new mission.

On condition that adequate representation of the States concerned and of the IIB can be achieved within the team referred to in the proposal of the delegation of the Federal Republic of Germany, the creation of a team of this kind could help to facilitate the setting up of the European Patent Office and the incorporation of the IIB within this latter.

Until the time when the above-mentioned extension of the search documentation of the European Patent Office has been completed and the Office has developed the capacity to carry out such search in an appropriate manner, the Administrative Council may decide, that this extended search be left to central industrial property offices of Contracting States equipped to carry out this task with sufficient competence. The conditions under which this can be done shall be laid down in an agreement between the Administrative Council and the national office in question. Such agreement shall be on the understanding that the European System for the Grant of Patents will not be delayed and that additional costs will not be incurred for the European Patent Organisation.

Taking into account

- that in the future technological development can not be restricted to national or regional frameworks;
- that industrialised countries with their economic structure are best able to promote technological progress;
- that not all countries in the world are able to promote technological progress to the same extent;
- that the efforts of developing countries to reduce the technological gap in relation to the developed countries should be promoted;
- that it is necessary to ensure that all countries are able to benefit from the results of technological progress;

THE CONFERENCE REQUESTS THE EUROPEAN PATENT ORGANISATION

to make use of all the possibilities available to it to help the developing countries, irrespective of their geographical location, in particular as concerns documentation, the training of staff and all other means likely to bring these countries increasingly closer to the highly developed countries.

The Conference for the setting up of a European System for the Grant of Patents, meeting at Munich on 5 October 1973
DESIRING to take all appropriate measures to enable the European Patent Office, in the interests of technical and economic development in Europe, to begin its activities as soon as possible,
HAS ADOPTED the following Resolution:

1. Upon signing the Convention establishing a European System for the Grant of Patents together with its annexed instruments, the Diplomatic Conference for the setting up of a European System for the Grant of Patents desires to thank the Council of the European Communities for having put its Secretariat and Legal Department at its disposal, as it did for its predecessor, the Inter-Governmental Conference for the setting up of a European System for the Grant of Patents. The same acknowledgements are likewise addressed to the Secretary-General of the European Free Trade Association. The Diplomatic Conference is convinced that these expert services in the formulation of international treaties have made a major contribution to the success of the work.

2. Desiring to ensure that the new European Convention, which has now been signed by ... States, is implemented, and that for this purpose the European Patent Office is opened, as soon as possible, the Diplomatic Conference requests the Council of the European Communities and the Secretary-General of the European Free Trade Association to likewise put at its disposal the aforesaid services for the interim work to be carried out after the dissolution of the Diplomatic Conference and to be concluded with the opening of the European Patent Office, which is envisaged for 1976.

Monsieur le Président,

Lors de sa réunion du 2 octobre, la Commission plénière a reconnu comme valables les pleins pouvoirs de 16 délégations, et a renvoyé à aujourd'hui la décision sur les pouvoirs de deux autres délégations. La Commission de vérification des pouvoirs vient de constater que les délégations belge et italienne ont également soumis des pleins pouvoirs en bonne et due forme. Elle recommande donc à la Conférence de reconnaître les pleins pouvoirs de ces deux délégations comme valables, de sorte que 18 délégations seront en mesure de signer la Convention.

Considérant que

- le développement de la technique ne saurait se limiter désormais à un cadre national ou régional ;
- les pays industrialisés sont les plus aptes, en raison de leur structure économique, à promouvoir le progrès technique ;
- tous les pays du monde ne sont pas aptes à promouvoir le progrès technique dans la même mesure ;
- il convient de favoriser les efforts déployés par les pays en voie de développement pour réduire le fossé qui les sépare, dans le domaine technique, des pays industrialisés ;
- il est nécessaire de faire en sorte que tous les pays soient en mesure de tirer profit des résultats du progrès technique,

LA CONFERENCE INVITE L'ORGANISATION EUROPEENNE DES BREVETS

Objet : Deuxième rapport de la Commission de vérification des pouvoirs à la Commission plénière

Monsieur le Président,

Vous vous rappelez que la Commission de vérification des pouvoirs a présenté un premier rapport le 25 septembre 1973 et qu'à la suite de ce rapport la Commission plénière a admis toutes les délégations gouvernementales à la Conférence. Toutes ces délégations sont donc en mesure de signer l'Acte final.

Le deuxième rapport que j'ai l'honneur de vous présenter aujourd'hui concerne dès lors uniquement les pleins pouvoirs permettant aux différentes délégations de signer la convention.

La Commission de vérification des pouvoirs a constaté que 16 délégations ont présenté des pleins pouvoirs de signature en bonne et due forme. 2 délégations (Belgique, Italie) ont fait savoir qu'elles soumettront des pleins pouvoirs au plus tard au moment de procéder à la signature ; 3 délégations enfin (Finlande, Autriche, Turquie) ont informé le Secrétariat qu'elles n'ont pas l'intention de soumettre des pleins pouvoirs autorisant dès maintenant la signature de la convention, sans préjudice, bien entendu, de la possibilité de signer dans le délai prévu par l'article 165 de la convention.

Dans ces conditions, la Commission de vérification des pouvoirs recommande à la Commission plénière de reconnaître comme valables les pleins pouvoirs de signature des 16 délégations suivantes :

La Conférence pour l'institution d'un système européen de délivrance de brevets, réunie le 5 octobre 1973 à Munich,

SOUCIEUSE de prendre toutes les mesures utiles pour que l'Office européen des brevets puisse, dans l'intérêt du développement technique et économique de l'Europe, commencer ses activités dès que possible,

ADOPTE la résolution suivante :

1. A l'occasion de la signature de la convention instituant un système sur la délivrance de brevets européens, la Conférence diplomatique pour l'institution d'un système européen de délivrance de brevets tient à remercier le Conseil des Communautés européennes d'avoir mis son Secrétariat, y compris son service juridique, à sa disposition, comme il l'a fait précédemment pour la Conférence intergouvernementale pour l'institution d'un système européen de délivrance de brevets. Il adresse également ses remerciements au Secrétaire Général de l'AELE. La Conférence diplomatique est convaincue que ces services experts en matière d'élaboration de traités internationaux ont apporté une contribution essentielle au succès de ses travaux.

2. SOUCIEUSE d'assurer que la nouvelle convention européenne, désormais signée par ... Etats, puisse entrer en application dès que possible et que l'Office européen des brevets puisse être ouvert à cet effet, la Conférence diplomatique prie le Conseil des Communautés européennes et le Secrétaire Général de l'AELE de mettre les services précités à sa disposition également pour les travaux à effectuer à titre intérimaire après la clôture de la Conférence diplomatique qui prendront fin avec l'ouverture de l'Office européen des brevets prévue pour 1976.

La Commission plénière a décidé à l'unanimité de transmettre à l'Assemblée plénière le texte de la convention sur le brevet européen, du règlement d'exécution et des quatre protocoles annexés à la convention, tels qu'ils figurent dans le document M/146/R 1 à 14, compte tenu des modifications suivantes (dans le texte imprimé, il a été tenu compte des modifications apportées aux renvois, de la correction des fautes d'orthographe et des erreurs de signes de ponctuation ; toutefois, il n'en a pas été tenu compte dans le présent document) :

(2) En vue d'harmoniser les activités de recherche au titre du Traité de Coopération dans le cadre du système européen de délivrance de brevets, il est établi une coopération entre l'Office européen des brevets et tout service central de la propriété industrielle autorisé à exercer une telle activité en vertu de la présente section. Cette coopération est fondée sur un accord spécial qui peut s'étendre, par exemple, aux procédures et méthodes de recherche, aux qualifications requises en ce qui concerne le recrutement et la formation des examinateurs, aux directives relatives aux échanges de recherche et d'autres services entre les offices, ainsi qu'aux autres mesures nécessaires au contrôle et à la surveillance.

== PROTOCOLE INTERPRETATIF ==
DE L'ARTICLE 69 DE LA CONVENTION

L'article 69 ne doit pas être interprété comme signifiant que l'étendue de la protection conférée par le brevet européen est déterminée au sens étroit et littéral du texte des revendications et que la description et les dessins servent uniquement à dissiper les ambiguïtés que pourraient recéler les revendications. Il ne doit pas davantage être interprété comme signifiant que les revendications servent uniquement de ligne directrice et que la protection s'étend également à ce que, de l'avis d'un homme de métier ayant examiné la description et les dessins, le titulaire du brevet a entendu protéger. L'article 67 doit, par contre, être interprété comme définissant entre ces extrêmes une position qui assure à la fois une protection équitable au demandeur et un degré raisonnable de certitude aux tiers.

II. La Commission plénière a, en outre, décidé à l'unanimité de transmettre à l'Assemblée plénière le texte de l'Acte final dans le texte suivant :

La Conférence diplomatique pour l'institution d'un système européen de délivrance de brevets, qui s'est réunie à Munich du 10 septembre au 5 octobre 1973, sur l'invitation du Gouvernement de la République Fédérale d'Allemagne, a arrêté

le texte de la convention sur la délivrance de brevets européens. Cette convention est ouverte à la signature jusqu'au 5 avril 1974.

EN FOI DE QUOI, les plénipotentiaires soussignés des Etats représentés à la Conférence ont apposé leurs signatures au bas du présent acte final.

FAIT à Munich, le cinq octobre mil neuf cent soixante-treize en un texte original rédigé en allemand, en anglais et en français qui est déposé aux archives du Gouvernement de la République Fédérale d'Allemagne.

La Commission plénière a, enfin, décidé à l'unanimité de transmettre à l'Assemblée plénière le texte de la décision concernant certains travaux préparatoires à l'ouverture de l'Office européen des brevets ainsi que le texte de la décision concernant la formation du personnel de l'Office européen des brevets tels qu'ils figurent dans le document M/146/R 15, compte tenu des modifications dans le texte anglais.

C'est avec un grand intérêt que la délégation de l'IIB a pris connaissance des propositions de la délégation allemande concernant l'organisation et le programme de travail du Comité intérimaire. Elle estime que ces propositions constituent une excellente base de discussion. En ce qui concerne sa propre participation aux travaux du Comité intérimaire, l'IIB estime devoir rappeler ce qui suit :

1. S'il est admis qu'une responsabilité particulière à l'égard de l'établissement du système européen des brevets incombe aux gouvernements allemand et néerlandais, la même constatation s'applique à l'IIB. En effet, cette organisation constituera le premier échelon de l'Office européen des brevets qui devra fonctionner pleinement. A ce titre, l'IIB, tout en conservant provisoirement un statut en vertu duquel il est soumis au seul contrôle de ses Etats membres, sera directement concerné par la plupart des mesures qui seront arrêtées par le Comité intérimaire, notamment dans le domaine de l'organisation de la recherche, du personnel, des finances et du droit contractuel (groupes de travail 1, 2, 3 et 5 des groupes prévus dans le document M/119/I). De ce fait, il incombera à l'IIB de contribuer activement à la conception et à la mise en oeuvre des travaux du Comité intérimaire et de ses organes. Eventuellement, d'importantes mesures de réorganisation internes à l'IIB, par exemple dans le domaine de la restructuration administrative, de la formation du personnel et du recrutement, devront être prises avant même l'incorporation de l'IIB dans l'organisation européenne.

Compte tenu de ce qui précède, la délégation de l'IIB estime qu'il est indispensable que la décision concernant certains travaux préparatoires "à l'ouverture de l'Office européen des brevets" (M 8) soit appliquée de manière à assurer une participation adéquate de l'IIB à tous les travaux tant du Comité intérimaire lui-même que de ses organes, cette participation devant notamment inclure le droit pour l'IIB de présenter des propositions et d'assumer des fonctions au sein de ces organes. La délégation de l'IIB estime que ces points devront être retenus expressément dans le règlement intérieur du Comité intérimaire.

2. La délégation de l'IIB juge très intéressante la proposition de constituer une équipe permanente composée d'une vingtaine de fonctionnaires chargés d'établir les documents de travail qui serviront de base aux délibérations du Comité intérimaire et de ses organes. A cet égard, il convient de souligner que le travail qui devra être effectué au sein du Comité intérimaire sera à maints égards d'une nature différente de celle du travail accompli antérieurement dans le cadre de la Conférence intergouvernementale.

En effet, la tâche du Comité intérimaire n'est pas limitée à l'établissement de textes mais sera progressivement étendue à la mise en oeuvre du système européen des brevets. Cette constatation s'applique tout particulièrement au domaine de la recherche, où l'activité des différents organes intéressés doit être adaptée et coordonnée en vue de leur nouvelle orientation.

A condition qu'une représentation adéquate des Etats intéressés et de l'IIB au sein de l'équipe visée dans les propositions de la délégation de la République fédérale d'Allemagne puisse être assurée, la constitution d'une telle équipe pourrait contribuer à faciliter la mise en place de l'Office européen des brevets et l'incorporation de l'IIB dans cet Office.
