Renewal fees for European patent applications

Article 129 of the Convention provides that renewal fees are to be paid to the European Patent Office in respect of European Patent applications.

The renewal fees for European patent applications are laid down as follows:

Only one renewal fee need be paid in respect of each European patent application, irrespective of whether only one or several countries have been designated.

The Netherlands delegation proposes that as well as the renewal fee an additional fee, calculated in proportion to the number of

designated countries, should be required. The EEC States should count as a single country.

This proposal has two advantages: firstly the revenue of the European Patent Office will be greater, and secondly the applicant will be forced to reconsider each year whether it is in his interest to reconfirm his designation of so many countries.

This principle does not appear to require the amendment of Article 129. It could be left to the Sub-Committee on Rules relating to Fees to adapt Article 2 accordingly.
