During the running-in period of the European Patent Office, its expenses should be covered by the contributions of the Contracting States in the absence of other financial resources. Article 42c gives the scales for determining these contributions in the form of two variants. Working Party IV was divided in its assessment of the relative merits of the scales proposed in the two variants (BR/57/70, page 55). The Netherlands delegation draws the attention of the Conference to the fact that for a similar purpose - covering the expenses arising in connection with PCT preparatory activities - the Executive Committee of the Paris Union drew up a scale of contributions which differs from both those contained in the variants. The "PCT" scale reflects the average of three factors: the number of domestic applications, the number of "exported" applications and the number of "imported" applications.
The Netherlands delegation considers that the "PCT" scale has the advantage of offering a system which has already been accepted by a large number of countries for reasons of fairness. These reasons are equally valid for the European Convention. The number of domestic applications reliably reflects the volume of work in each national patent office and, as the Convention will be useful in general to these

offices (and not only as regards European applications) this number should be one of the factors taken into consideration; the number of exported applications is a relevant criterion as the Convention will facilitate the filing of patent applications abroad; and finally, the number of imported applications is also a relevant criterion as the Convention will substantially reduce the amount of work of the national patent offices on applications from abroad.
The PCT system contains two modifications. The first does not apply to the European system, as the total of the domestic, exported and imported applications exceeds the minimum of 1,000 in all the countries of the Conference. The second modification applies to the countries which do not make a complete examination of domestic applications, such as Belgium, Spain, Greece, Italy, Luxembourg, Portugal, Switzerland and Turkey. As in these countries the grant of European patents after a preliminary examination concerns only the public and the courts, and not the patent offices, it seems reasonable that the number of imported applications should be reduced by half.
As a third variant of Article 42c, under which the PCT scale would be accepted, the Netherlands delegation proposes the following text:

year but one prior to the date of entry into force of this Convention:
(a) number of applications filed with the national patent office of each Contracting State; (b) number of applications filed abroad by the residents of each Contracting State (exported applications); (c) number of applications received from abroad by the national office of each Contracting State (imported applications).
However, for the Contracting States which do not make a complete examination of domestic applications, the number of imported applications shall be reduced by half".
A calculation of the rates of contribution under the PCT method is attached (Annex I), as is a comparative table of the systems contained in the two variants of Article 42c and of the PCT system.
